Welcome to mytinerary. By accessing or using our AI-powered trip planning service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

2. Description of Service

mytinerary is an AI-powered trip planning platform that generates personalized travel itineraries based on your preferences and requirements. The Service includes:

  • AI-generated trip itineraries using large language models (LLMs)
  • Conversational editing to refine and customize your plans
  • Venue verification using third-party APIs (Google Places)
  • Multi-city trip planning capabilities
  • Itinerary sharing and collaboration features
  • Both free and premium subscription tiers

3. User Accounts

3.1 Account Creation

You may use the Service without creating an account for basic features. To access certain features, you must create an account by providing accurate and complete information. You may register using:

  • Email and password
  • Third-party OAuth providers (Google, Microsoft, Apple)

3.2 Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your account information remains accurate and current

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion. You may delete your account at any time through your account settings.

4. Acceptable Use

You may use the Service only for lawful purposes and in accordance with these Terms.

5. AI-Generated Content

5.1 Nature of AI Content

mytinerary uses artificial intelligence and large language models to generate trip itineraries. While we strive for accuracy through verification systems (Google Places API), AI-generated content may contain errors, inaccuracies, or outdated information.

5.2 No Guarantees

We do not guarantee the accuracy, completeness, reliability, or suitability of AI-generated itineraries. You are responsible for:

  • Verifying all information before making travel decisions
  • Confirming venue hours, availability, and booking requirements
  • Checking current travel advisories and restrictions
  • Ensuring compliance with visa and entry requirements
  • Validating safety and accessibility information

5.3 Third-Party Content

Itineraries may include information sourced from third-party APIs and databases. We are not responsible for the accuracy or reliability of third-party content.

6. Intellectual Property

6.1 Our Rights

The Service, including its software, design, graphics, text, and other content (excluding user-generated content), is owned by mytinerary and protected by copyright, trademark, and other intellectual property laws.

6.2 Your Rights

You retain ownership of any content you provide to the Service, including trip descriptions and preferences. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and process your content solely to provide the Service to you.

6.3 AI-Generated Itineraries

Itineraries generated by the Service are provided for your personal use. You may share, modify, and use generated itineraries for personal, non-commercial purposes. You may not resell or redistribute itineraries as a competing service.

7. Payment and Subscriptions

7.1 Free Tier

mytinerary offers a free tier with limited features. Free tier users may experience:

  • Limited number of itinerary generations per month
  • Slower AI processing (Groq/Llama 3 instead of GPT-5.1)
  • Basic features only

7.2 Premium Subscriptions

Premium subscriptions provide access to advanced features including:

  • Unlimited itinerary generations
  • GPT-5.1 powered itineraries for complex trips
  • Multi-city planning
  • Priority support
  • Advanced customization options

7.3 Billing

Subscription fees are charged in advance on a recurring basis (monthly or annually) and are non-refundable except as required by law. You authorize us to charge your payment method for all fees incurred.

7.4 Cancellation

You may cancel your subscription at any time. Cancellation will be effective at the end of your current billing period, and you will retain access to paid features until that date. No refunds will be provided for partial billing periods.

7.5 Price Changes

We reserve the right to modify subscription prices at any time. We will provide at least 30 days' notice of any price changes. If you do not agree to the price change, you may cancel your subscription.

8. Disclaimers

8.1 "As Is" Basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

8.2 No Travel Advice

mytinerary is not a travel agency and does not provide professional travel advice. We do not:

  • Make travel bookings or reservations
  • Provide travel insurance or financial protection
  • Guarantee the availability of venues or services
  • Provide medical, safety, or legal advice
  • Assume liability for travel decisions made using the Service

8.3 Third-Party Services

The Service may integrate with third-party services and APIs. We are not responsible for the availability, accuracy, or reliability of third-party services, and their use is subject to their own terms and conditions.

8.4 Affiliate Disclosure

Some links in the Service — including links to book tours — are affiliate links. When you click such a link and complete a booking on the partner's site, mytinerary may earn a commission at no additional cost to you. Our current affiliate partner is Viator. We may add additional partners in the future and will update this disclosure accordingly.

These commercial relationships do not influence the AI's recommendations. Itineraries are generated based on your preferences and verified venue data; we never prioritize bookable inventory over recommendations that better match your trip.

When you complete a booking on a partner's site, the booking, payment, cancellation, and customer support are handled entirely by that partner under their terms. We are not party to that transaction.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYTINERARY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or personal information
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code transmitted through the Service
  • Any errors or omissions in content or AI-generated itineraries
  • Travel decisions made based on AI-generated content
  • Any third-party content or services accessed through the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify, defend, and hold harmless mytinerary and its affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property rights
  • Any content you submit or transmit through the Service
  • Travel decisions made using itineraries generated by the Service

11. Dispute Resolution

11.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute informally within 60 days.

11.2 Binding Arbitration

If we cannot resolve the dispute informally, any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in English.

11.3 Class Action Waiver

YOU AND mytinerary AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

11.4 Exceptions

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any actions not subject to arbitration shall be brought in courts of competent jurisdiction.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and mytinerary regarding the Service and supersede all prior agreements.

13.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

13.5 Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
